NATARAJ ORAL ORDER The petitioner has sought for a writ in the nature of mandamus to consider his representation dated 26.02.2026 for allotment of an alternate site in Sir M.Vishweshwaraiah Layout. 2. The petitioner contends that a portion of land belonging to him and his brothers situated in various survey numbers of Gollahalli Village, was relinquished in favour of the respondent Bangalore Development Authority vide relinquishment deed dated 13.06.2013. Following this, the - 3 - HC-KAR NC: 2026:KHC:26388 WP No. 11817 of 2026 respondent BDA allotted 4 sites to the petitioner and his brothers. As regards the 3 sites, there is no issue, while in respect of the 4th site bearing No. 1107/B in 3rd sector HSR layout, the same lies within the park zone and is not identifiable. 3. (ii) The petitioner therefore gave representation to respondent No.3 on 26.02.2026, requesting the respondent No.3 to allot a site measuring 50 X 80 feet in Sir M. Vishweshwaraiah Layout. Being aggrieved by the non- consideration of his representation, the petitioner is before this Court. 4. Learned counsel for the petitioner reiterated the above submissions and submitted that a direction be issued to the respondent No.3 to consider the representation. 5. Learned counsel for the respondent on the other hand submitted that the learned counsel for the petitioner has hastily approached this Court even before the respondent No.3 could consider the representation. He however submits that if reasonable time is granted, the respondent No.3 would consider the representation. - 4 - HC-KAR NC: 2026:KHC:26388 WP No. 11817 of 2026 6. In view of the fact that the petitioner was granted a site by the respondent which purportedly is not identifiable, the respondent No.3 is bound to consider the representation of the petitioner and pass appropriate orders. 7. In that view of the matter, I pass the following order: ORDER i. The petition is allowed; ii. The respondent No.3 is directed to consider the representation of the petitioner dated 26.02.2026, for allotment of an alternate site measuring 50 X 80 feet in Sir M Vishweshwaraiah Layout, within a period of three months from the date of receipt of certified copy of this order.
