The present appeal was filed by the appellants, who were the legal heirs of original plaintiffs before the learned trial Court, i.e. the Court of Additional District Judge-II, Solan, District Solan, H.P., against the judgment and decree dated 12.01.2015. After hearing the learned counsel for the parties, this Court has set aside the aforesaid judgment and decree passed by the learned trial Court and remanded the case back to the learned trial Court for decision afresh in accordance with law on or before 30.06.2026. However, vide communication dated 02.07.2026, a request has been received from the learned Additional District Judge-II, Solan, District Solan, H.P., seeking extension of time to dispose of Civil Suit No. 3ADJ-II/1 of 2014/2007, which was allowed by this Court and time to decide the aforesaid suit was further extended by 31.08.2026. Now a request has been received from the learned Additional District Judge-II, Solan, District Solan, H.P., that since the pecuniary jurisdiction of the Court of Additional District Judge has been enhanced in all the Original Civil Suits, the value of which exceeds Rs. 60,00,000/-, but does not exceed Rs. 1,00,00,000/-, whether Court of Additional Judge should proceed to decide the above titled suit or should forward it to the Court of Civil Judge, Nalagarh, where the pecuniary as well as territorial jurisdiction to decide the matter lie. As per Notification dated 03.10.2013, the Court of Civil Judge shall exercise the jurisdiction in all Original Civil Suits, the value of which does not exceed Rs. 30,00,000/- (rupees thirty lakhs). Since the present suit has been filed for recovery of damages of Rs. 20,50,000/- alongwith future interest, therefore, in view of the aforesaid Notification, learned Additional District Judge-II, Solan, District Solan, H.P., is directed to transfer the matter to the Court of learned Civil Judge, Nalagarh, District Solan, H.P.
