1. This application is filed on behalf of the Plaintiff under Order I Rule 10(2) read with Section 151 CPC for impleadment of M/s Akram Store as Defendant No. 6 in the array of parties on the ground that during the execution of the proceedings by the Local Commissioner details of proposed Defendant No.6 were revealed as being the party from whom Defendants No.3 and 4 had purchased bulk quantities of counterfeit cigarettes bearing Plaintiff’s trademarks. 2. For the reason stated in the application, the same is allowed, impleading M/s Akram Store as Defendant No. 6 in the suit. This is a digitally signed order. 5. This application is jointly filed by the Plaintiff and Defendant No. 3 under Order XXIII Rule 3 read with Section 151 CPC for recording of settlement between the parties. 6. This suit was instituted by the Plaintiff for restraining the Defendants and all others acting on their behalf from infringing Plaintiff’s ESSE family of marks by selling counterfeit goods as also for passing off and other reliefs. During the pendency of the suit, Plaintiff and Defendant No. 3 have settled their inter se disputes and terms of settlement are incorporated in paragraph 4 of the application, which Court has perused and finds the same to be lawful. 7. Accordingly, this application is allowed and disposed of, recording the settlement between the parties. I.A. 25387/2026

17. Suit was decreed qua Defendant No. 4 vide order dated 22.07.2026.
Learned counsel for the Plaintiff, on instructions, gives up the reliefs against Defendant No. 5/John Doe.
18. In light of the settlement between the Plaintiff and Defendants No. 1, 2, 3 and 6, the suit is decreed in favour of the Plaintiff and against the said Defendants. Suit stands decreed qua Defendant No.4 and Plaintiff has given up reliefs against Defendant No.5.
19. Registry is directed to draw up the decree sheet.
20. Suit stands disposed of along with the pending application.
21. Plaintiff is held entitled to refund of entire court fees in accordance with the Court Fees Act, 1870.
22. Date of 28.09.2026 before the learned Joint Registrar is cancelled.
