Also heard Mr. Bhaskar Sharma, learned Additional Public Prosecutor, Assam. By this application filed under Section 482 of the BNSS, 2023, the petitioner Rati Kanta Pegu has prayed for pre-arrest bail in connection with Silapathar P.S. Case No. 28/2026. On 14.02.2026 while the HSSLC Examination was going on, one girl was caught red Page No.# 2/2 handed when she was using unfair means in the examination hall. Later on, after the examination, while the girl was crossing the road she met with an accident and sustained injuries. On seeing the incident, a mob of some people entered into the school and caused damage to the school property and also mishandled the school authorities. I have perused the Case Diary. The Case Diary does not have sufficient incriminating materials against the present petitioner. Hence, the petitioner does not deserve to be detained in custody. Accordingly, it is hereby directed that in the event of arrest of the petitioner Sri Rati Kanta Pegu in connection with Silapathar P.S. Case No. 28/2026, the arresting authority shall release him on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the arresting authority. The petitioner is directed to appear before the Investigating Officer within 10 (ten) days from today and shall cooperate in the investigation as and when called for.
