KKD202512015760, dated. 16-12-2025 seeking to correction of House Tax and also cancel the house tax which was wrongly entered the names of the unofficial respondents. The petitioner made several requests to cancel the House Tax which was entered wrongly in the names of unofficial respondents and not correcting the same as illegal, arbitrary, unjust, malafide and against the principles of Natural Justice besides violation of Article 14, 21 and 300-A of the Constitution of India and to pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to enquire into the representation made by the petitioner and also direct the respondents to cancel the erroneous house tax entries made in the names of the unofficial respondents and to mutate the name of the petitioner in the house tax records by following due procedure as contemplated under law. And also pleased to direct the respondents to not to effect any further changes or entertain any transactions in respect of the subject property in the interest of justice and to pass Counsel for the Petitioner: 1. GP FOR PANCHAYAT RAJ RURAL DEV The Court made the following order: Heard Ms. B.Sowmya, learned counsel representing Ms. Vasavi Ratna Kumari Dandamudi, learned counsel for the petitioner, Sri P.Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj and Rural Development for the respondents 1 and 2 and Sri Chaitanya, learned counsel representing Sri Y.Koteswara Rao, learned Standing counsel for the 3rd respondent. The notice in respect of the respondents 4 to 9 is dispensed with, since no adverse order is passed affecting the interest of the respondents 4 to 9. 2. The petitioner made a complaint in PGRS regarding the mutation of the names of the respondents 4 to 7 in respect of the structure bearing D.No.1-58 of Atchutapuram Village, Pedapudi Mandal, West Godavari District. The Panchayat Secretary of the 3rd respondent issued an endorsement dated 17.12.2025 (Ex.P1). 3. Learned counsel for the petitioner would submit that, despite the endorsement dated 17.12.2025 (Ex.P1), the Panchayat Secretary of the 3rd respondent has not passed any order to date. 4. Sri Chaitanya, learned counsel representing Sri Y.Koteswara Rao, learned Standing counsel for the 3rd respondent, would submit that the Panchayat Secretary of the 3rd respondent called upon the respondents 4 to 7 to submit the documents, and the respondents 4 to 7 have submitted the documents. After giving the opportunity of hearing to both parties, the authority will pass appropriate orders strictly as per the Rules. 5. A perusal of the endorsement dated 17.12.2026 (Ex.P1), would indicate that, in pursuance of the complaint made by the petitioner, the Panchayat Secretary of the 3rd respondent called upon the respondents 4 to 7 to submit the documents, and they submitted the documents. It seems that the authority has sought legal opinion, and after receipt of the same, will pass appropriate orders. 6. Given the facts and circumstances of the case, without going into the disputed questions of fact, the writ petition is disposed of at the stage of admission with the consent of all the learned counsel, directing the Panchayat Secretary of the 3rd respondent to pass appropriate orders on the complaint made by the petitioner regarding the mutation in respect of the house bearing D.No.1-58 of Atchutapuram Village, Pedapudi Mandal, West Godavari District, after conducting an inquiry by giving an opportunity of hearing to both the petitioner and respondents 4 to 7, and pass appropriate orders strictly as per law, as expeditiously as possible. There shall be no order as to costs.
