ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)
1. For the reasons stated in the application - I.A.No.1/2025, the same is allowed. Order dated 05.11.2025 is recalled.
2. The complainant has filed the present complaint alleging willful disobedience of the order dated 23.09.2014 passed by this Court in MFA No.8/2010 (FC-DB).
3. The said appeal was disposed of in terms of a settlement arrived at between the parties, who were the parents of the

complainant. The said order records that the complainant's father (Sri.T.S.Ramesh) had agreed to give the complainant 12.50% of his shares in the joint family property bearing No.6/13, Police Station road, Basavanagudi, Bengaluru, and treat it as an integral part of the joint development agreement. The complainant claims that despite the said order, his father has declined to assign the 12.50% share in his favour.
4. The complainant was not a party to the said proceedings (MFA No8/2010). However, he claims his rights pursuant to the settlement arrived at between his parents. We do not consider it apposite to entertain any proceedings under Contempt of Courts Act, 1971. The complainant is, however, not precluded from enforcing his claims in accordance with law. The complaint is, accordingly, dismissed.
