In this petition, the petitioner is assailing the order dated 04.01.2022 passed in a Revision 22/2021-22 (Revision Petition No.15/2019-20) (Annexure-A), by respondent No.3 and the Survey Hissa Phodi for the land bearing Sy.No.55/1 and 55/2 of Narasandra Village, Kudur Hobli, Magadi Taluk, Ramanagar District. 3. Learned counsel appearing for the petitioner by referring to the observations made by respondent No.3 at Annexure-A argued that the claim made by the petitioner was rejected on the ground that the petitioner was unable to produce the relevant documents and the sketch as to the acquisition of portion of the land in Sy.No.55 of Narasandra Village, Magadi Taluk. Learned counsel further argued that pursuant to the order passed by respondent No.3 at Annexure A, the petitioner has obtained the relevant documents under the provision of RTI and therefore, sought for production of the same before the competent authority. - 4 - HC-KAR NC: 2026:KHC:26355 WP No. 10438 of 2022 4. The said petition was opposed by learned HCGP and the learned counsel appearing for respondent No.4. 5. Taking into consideration the observations made by respondent No.3 at Annexure A, wherein, rejection of the claim made by the petitioner was on the ground that the petitioner was unable to produce the relevant document with respect to the extent of land acquired by the competent authority vis-a- vis the survey sketch. 6. In that view of the matter, as the petitioner has obtained the same subsequent to passing of the impugned order at Annexure-A, I find force in the submission made by the learned counsel of the petitioner. Accordingly, it is open for the petitioner to produce the same before respondent No.3 and thereafter, respondent No.3 shall take a decision. 7. Accordingly, I pass the following: ORDER (i) The Writ Petition is allowed. - 5 - HC-KAR NC: 2026:KHC:26355 WP No. 10438 of 2022 (ii) The order dated 04.01.2022 in Revision 22/2021-22 (Revision Petition No.15/2019-20) passed by respondent No.3 is accordingly set aside. (iii) The matter is remanded to respondent No.3 for fresh consideration after issuing notice to all the parties concerned. (iv) In the meanwhile, it is open for the petitioner to produce relevant documents before respondent No.3. (v) Since the parties are represented through their counsel, the parties are directed to appear before respondent No.3 on 07.07.2026 at 2.30 p.m. (vi) Upon appearance of the parties, respondent No.3 is directed to conclude the matter within three months from that date.
