05/06.07.2026 Heard the learned counsel appearing on behalf of the parties.
2. The learned counsel for the petitioner submits that the petitioner is in custody since 18.01.2026 in connection with Basantrai P.S. Case No.05/ 2026 (Special [POCSO] Case No.10/ 29026) for the offence registered under Sections 65 (1) / 351 (2) of the B.N.S. 2023 and under section 4 of the POCSO Act, 2012 and the case is pending in the court of learned District & Addl. Sessions Judge- 1st – cum- Special Judge (POCSO), Godda.
3. The learned counsel for the petitioner submits that as per the FIR, the date of incident is dated 20.12.2025, but the FIR has been lodged on 17.01.2026 and the victim has denied for her medical examination.
4. He further submits that there was talk of marriage between the petitioner and the victim, aged about 13 years which later on did not materialize. The talk of marriage took place on 17.09.2025 and the Petitioner is in custody since 18.01.2026.

The learned counsel for the opposite party-State has opposed the prayer and has submitted that the victim is aged only 13 years and there is direct and specific allegation against the petitioner and further victim has also supported the allegation in the statement recorded under Section 183 BNSS, 2023.
6. After hearing the learned counsel for the parties and considering the specific allegation made against the petitioner and the same was supported in statement recorded under Section 183 BNSS, 2023, this Court is not inclined to enlarge the petitioner above named
( 2026:JHHC:19751 ) on bail. Accordingly, prayer for bail of the petitioner above named is rejected.
