The present petition has been filed by the petitioner under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for quashing of C.C N.I Act No. 285/2024 u/s 138 r/w section 142 of The Negotiable Instrument Act, 1881, pending before the learned Judicial Magistrate, First Class- 04, NI Act, Central District, Tis Hazari Courts, Delhi. 2. The petitioner assails the summoning order(s) dated 13.08.2024 and order dated 18.11.2025, issuing Bailable Warrants (BW) against the petitioner no. 2. 3. It transpires that after filing of the present petition, an order dated 07.08.2026 was passed by the learned Judicial Magistrate in the aforesaid proceedings whereby the Non-Bailable Warrants (NBWs) have been issued against the accused. 4. In the circumstances, learned counsel appearing for the petitioner confines herself to seeking that the NBWs issued vide order dated 07.08.2026 against the petitioner/s, be quashed. 6. It is pointed out that the impugned complaint itself discloses that the email dated 14.09.2023 was addressed by the petitioner to the complainant, in terms of which it was agreed that an amount of Rs.12,83,386/- is payable by the petitioner to the complainant. 7. It is admitted by the learned counsel for the complainant that an amount of Rs.5,90,000/- has been received by the complainant from the accused. Learned counsel for the petitioners submits that a further amount of Rs.6,93,386/- shall be deposited in the concerned Trial Court within a period of one week from today. 8. Learned counsel for the respondent submits that the liability of the petitioners is far more than what is being projected. This aspect shall necessarily be considered by the trial Court and this Court expresses no opinion with regard thereto. 9. It is further undertaken by the learned counsel for the petitioners, on instructions, that the petitioner no. 2 shall remain present before the Trial Court on every date of hearing and shall not seek any adjournment whatsoever. It is further undertaken that if the petitioner seeks to appear virtually (instead of physically), an appropriate application shall be filed and permission of the trial Court shall be specifically sought for each date on which the petitioner seeks to appear virtually. 10. Subject to the aforesaid undertaking and the deposit of the aforesaid This is a digitally signed order.
