JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.2 in Crime No.544/2025 registered by Jnanabharathi Police Station, Bengaluru for offence punishable under Section 310(2) of BNS, 2023 is before this Court in this bail petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.544/2025 was registered by Jnanabharathi Police Station, for aforesaid offences against six unknown persons based on the first information dated 31.12.2025 received from Karan Frances S/o Stalin Frances. - 3 - HC-KAR NC: 2026:KHC:26704 CRL.P No. 5297 of 2026 4. During the course of investigation, petitioner was arrested on 02.03.2026 and remanded to judicial custody. After completing the investigation, charge sheet was filed against three persons and the petitioner is arraigned as accused No.2 in the charge sheet. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.2225/2026 was rejected on 10.03.2026. Therefore, petitioner is before this Court. 5. In the first information dated 31.12.2025, it is stated that about 5.20 a.m., when the first informant was walking towards Kenchanapura Cross within the jurisdiction of Jnanabharathi Police Station, six unknown persons came in an auto and after restraining him asked him to pay money for smoking Ganja. Thereafter, one of them snatched his gold chain weighing 12 grams and another person hit him with a wooden piece and all of them escaped from the spot. Allegation of snatching the gold chain from first informant is found in the charge sheet against accused No.1, who was arrested. The said gold - 4 - HC-KAR NC: 2026:KHC:26704 CRL.P No. 5297 of 2026 chain is recovered from the possession of the accused No.1. Accused No.1 has now been granted regular bail, by the jurisdictional Sessions Court in Crl.Misc. No.4583/2026 disposed of on 14.05.2026. It is not in dispute that the petitioner has no other criminal antecedents. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner aged about 19 years for grant of regular bail needs to be answered affirmatively. Accordingly, the following:- ORDER The Criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.544/2025 registered by Jnanabharathi Police Station, Bengaluru for the offence punishable under Section 310(2) of BNS, 2023 subject to the following conditions; a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for - 5 - HC-KAR NC: 2026:KHC:26704 CRL.P No. 5297 of 2026 the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
