JUSTICE K.S. HEMALEKHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging willful disobedience of the order dated 27.02.2025 passed by the learned Single Judge in W.P.No.20126/2021 (LA-BDA). The operative part of the said order reads as under: "a) Petition is allowed. Impugned endorsement dated 22.09.2021 produced at Annexure-R is quashed. b) Respondent-BDA is directed to consider the case of the petitioner for allotment of alternate site by considering the application dated 16.12.2002 produced at Annexure-F in the light of observations at paragraph 57(1)(f) of the JUNJAMMA’s case as extracted at paragraph 6 above. c) It is further directed that the respondent-BDA shall raise demand for the cost of site as per the rates prevailing in the year 2013. d) Such consideration and demand shall be made within the outer limit of eight weeks from the date of receipt of copy of this order." - 4 - HC-KAR NC: 2026:KHC:26276-DB CCC No. 201 of 2026 2. In compliance with the said order, the accused has allotted a site to the complainant. To that extent the order is complied with. However, the accused has demanded the consideration on the basis of rates prevailing as on date and not at the rates prevailing in the year 2013. 3. The learned counsel for the complainant submits that the same is contrary to clause (c) of the directions issued in the order dated 27.02.2025. 4. Notwithstanding the same, the learned counsel for the complainant states that the complainant will deposit the amount as demanded in this Court while reserving the complainant's rights in this regard. 5. The learned counsel for accused Nos.1 and 2-Bangalore Development Authority (BDA) submits that the BDA has filed an appeal against the order dated 27.02.2025, the disobedience of which is alleged, and that the challenge to the direction to allot sites at the rates prevailing in the year 2013 is under consideration. 6. Considering that the learned counsel for the complainant has volunteered that the entire amount as demanded would be deposited before the Registry of this Court within a period of two - 5 - HC-KAR NC: 2026:KHC:26276-DB CCC No. 201 of 2026 weeks from date, we do not consider it necessary to continue the present proceedings. The amount deposited in this Court shall be subject to the outcome of the appeal filed by the BDA W.A.(FR)No.1522/2026. However, the accused shall proceed to take further steps pursuant to the said allotment. 7. The complaint is closed with the aforesaid directions.
