JUSTICE ANUBHA RAWAT CHOUDHARY --- For the Petitioner : Mr. Gaurav, Advocate For the Opp. Party : Mr. Gautam Rakesh, APP --- 06/07.07.2026 A counter-affidavit has been filed during the court proceedings, which is taken on record. 2. Heard the learned counsels appearing on behalf of the parties. 3. Learned counsel for the petitioner submits that the petitioner is in custody since 11.02.2026 in connection with Torpa P.S. Case No. 11 of 2026, registered under Section 80(2) of Bhartiya Nyaya Sanhita, 2023, now pending in the court of learned Sub Divisional Judicial Magistrate, Khunti. 4. Learned counsel for the petitioner further submits that the petitioner has been falsely implicated in this case. The petitioner is the husband of the deceased and marriage was solemnized about a year ago from the incident. He submits that as per the First Information Report, immediately after the marriage, the petitioner had been torturing his wife for demand of dowry and also used to assault her after taking alcohol. However, the petitioner had gone to the house of the informant for the purpose of marriage anniversary. It is further alleged that while wife of the petitioner was in her parental home (house of the informant) only, she was assaulted by the petitioner which ultimately led to her death. 5. The learned counsel for the petitioner also submits that the wife was taken to the hospital on 10.02.2026 and was referred to higher center and ultimately, she died, but the doctor who examined the wife, did not report any injury to any police. The learned counsel has submitted that the informant has improved her case while giving the 2026:JHHC:19880 2 restatement before police. 6. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer for bail and has submitted that there is direct allegation against the petitioner. 7. After hearing the learned counsels for the parties and considering the nature of allegation and the fact that there is direct allegation against the petitioner that the petitioner had assaulted his wife and there was repeated demand of dowry and he used to assault his wife after taking alcohol coupled with the fact that the wife of the petitioner died by hemorrhage shock due to hard blunt object and in view of the materials recorded in the case-diary, this Court is not inclined to enlarge the petitioner on bail and hence, this bail application is rejected. 8. Let a copy of this order be communicated to the learned court concerned through “FAX/email”. (Anubha Rawat Choudhary, J.) Date of Order:07.07.2026 Pankaj Date of Uploading:08.07.2026
