Mr. Navishek Kashyap, Advocate, vice Mr. Varun Chauhan, Advocate, for respondent No.1. Ms. Ayushi Negi, Deputy Advocate General, for respondent No.2. OMP (M) No.170 of 2026 Reply not filed, despite last opportunity. Further adjournment for this purpose is not justifiable. As such, the right of the respondent to file reply is closed by the order of the Court. By way of the present application, a prayer has been made to condone the delay, as occurred in filing the accompanying appeal. As per the application, there is delay of 246 days, however, as per the report of the Registry, there is delay of 358 days, as occurred in filing the main appeal. The delay has been sought to be condoned on the ground that before filing the accompanying appeal, the matter has been dealt with at various levels. And the counsel representing the applicant had met with an accident and the doctor advised him complete bed rest. Due to his medical condition, the applicant could not prepare and file the appeal within the prescribed period of limitation. The application is duly supported by the affidavit of Project Director, NHAI. Reply to the application has not been filed, despite opportunity granted. As such, the factual position/ explanation, as asserted in the application, qua ailment of the counsel representing the applicant, remains uncontroverted/unrebutted, which is sufficient to condone the delay, as occurred in filing the main appeal. Consequently, the present application is allowed and the delay, in filing the main appeal is condoned. The application stands disposed of. Arb. Appeal No. of 2026 Be registered. Admit.
