Order 08/01/2026
1. Apprehending his arrest in connection with FIR No.51/2024 registered at Police Station Khoh, District Deeg for the offences under Sections 413, 419, 420, 467, 468, 471 and 120-B of IPC and Section 66D of IT Act, the accused-petitioner has preferred the anticipatory bail application under Section 482 BNSS.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case solely on the basis of disclosure statement of the other co-accused. The accused-petitioner neither involved in committing any cyber fraud nor any amount was transferred in his account. The petitioner is ready and willing to cooperate with the investigation, therefore, the anticipatory bail application of the accused-petitioner may be allowed. [2026:RJ-JP:569] (2 of 3) [CRLMB-13584/2025]
3. Learned Public Prosecutor vehemently opposes the bail application and contended that the other co-accused was caught red handedly and in their bank accounts, several transactions were found and they have misused their mobile numbers by creating fake ID's and extorted money from several persons, therefore, considering the allegation levelled against the petitioner, the anticipatory bail application of the accused- petitioner may be dismissed. 4. Heard and perused the material available on record. 5. Apart from the disclosure statement of the other co-accused, there is no other substantive evidence available on record indicating the petitioner's involvement in committing cyber fraud by using his mobile numbers or any amount was deposited in petitioner any account, therefore, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner. 6. Accordingly, the anticipatory bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioner Javed S/o Hakam, in connection with FIR No.51/2024 registered at Police Station Khoh, District Deeg, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make themselves available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or

(iv) that the petitioner would submit his Mobile phones and Sim Cards before the concerned Investigating Officer. (v) that the accused-petitioner would submit his contact details along with the present address to the concerned Investigating Officer.
