Accused no.5 in S.C.No.1103/2017 pending before the court of LXI Addl. City Civil & Sessions Judge, Bengaluru arising out of Crime No.21/2014 registered by Hanumanthanagar Police Station, Bengaluru City for the offences punishable under Section 392 & 411 of IPC is before this Court in this successive bail application filed under section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and learned HCGP for respondent - State. 3. Learned counsel for the petitioner submits that, on the merits of the case the petitioner was granted regular bail by this Court in Crl.P.No.4298/2019 disposed of on 23.09.2019 only for the reason that the petitioner had not appeared before the trial Court on the regular dates of hearing after March, 2024 he has been arrested in the present case. He submits that, the petitioner is now in custody from 26.12.2024. Accordingly, he prays to allow the petition. - 3 - HC-KAR NC: 2026:KHC:26473 CRL.P No. 4205 of 2026 4. Per contra, learned HCGP who opposed the petition submits that the petitioner is a person with criminal antecedents and he is also a rowdy-sheeter. He has not cooperated before the trial Court on the regular dates of hearing. He accordingly, prays to dismiss the petition. 5. It is not in dispute that the petitioner who was arrested in the present case was granted regular bail by the Coordinate Bench of this Court in Crl.P.No.4298/2019 by order dated 23.09.2019. It appears that, thereafter the petitioner was regularly appearing before the trial Court and for the reason that he had not appeared before the trial Court on the regular dates of hearing the trial Court had issued non-bailable warrant against him on 05.03.2024. His presence was thereafter secured before the trial Court on 26.12.2024 and on the said date he was remanded to judicial custody. He is now in custody for the last nearly six months. For the mistake committed by not appearing before the trial Court on the regular dates of hearing petitioner has been sufficiently punished. - 4 - HC-KAR NC: 2026:KHC:26473 CRL.P No. 4205 of 2026 6. Undisputedly, on the merits of the case he has been granted bail in the present case. The alleged offences in the present case are not punishable with death or life imprisonment. The material on record would go to show that, the petitioner was enlarged on bail in the present case by the Coordinate Bench of this Court in Crl.P.4298/2019 disposed of on 23.09.2019. He has not involved in any other criminal cases after 2019. All criminal cases which are registered against him are prior to the year 2019. Under the circumstances, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to certain stringent conditions. 7. Accordingly, the following:- ORDER The petitioner is directed to be enlarged on bail in S.C.No.1103/2017 pending before the court of LXI Addl. City Civil & Sessions Judge, Bengaluru arising out of Crime No.21/2014 registered by Hanumanthanagar Police Station, Bengaluru City for the offences punishable under Section 392 & 411 of IPC, subject to the following conditions: - 5 - HC-KAR NC: 2026:KHC:26473 CRL.P No. 4205 of 2026 a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall appear before the Station House Officer of Hanumanthanagar, Bengaluru on every alternative Sunday between 10.00 a.m, and 01.00 p.m, and mark his attendance till the case registered against him is disposed of.
