Learned counsel for the petitioner submits that the petitioner is in custody since 24.10.2025 in connection with Balbadda P.S. Case No.73 of 2025 (Special [POCSO] Case No.111 of 2025) for the offences registered under Sections 75(2), 76, 64, 62, 109 (1), 3(5) of the B.N.S. 2023 and the case is pending in the court of learned District & Session Judge-I-cum- Special Judge, POCSO, Godda. 3. Learned counsel for the petitioner submits that petitioner is in custody since 24.08.2025 and it is alleged in the FIR that the petitioner has applied force upon the victim to commit wrong, but when she has raised alarm, she was pushed into well from where she was subsequently recovered. 4. He further submits that the victim has completely denied her medical examination and if she was put into the well, she ought to have suffered some injury. 5. Learned counsel for the opposite party-State has opposed the prayer. However, the aforesaid submissions made by counsel for the petitioner have not been disputed. 6. After hearing the learned counsel for the parties and considering the custody of the petitioner i.e. since 24.10.2025, this Court is inclined to enlarge the petitioner on regular bail. 7. Accordingly, the petitioner above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 25,000/- (Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned District & Session Judge-I-cum- Special Judge, 2026:JHHC:19716 2 POCSO, Godda, in connection with Balbadda P.S. Case No.73 of 2025 (Special [POCSO] Case No.111 of 2025) on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned court below. 8. Let this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through FAX/e-mail. 9.
