Judgment 05/02/2026
1. Appellant has preferred this appeal challenging the order dated 29.08.2022 passed by learned Single Judge in S.B. Civil Writ Petition No. 11721/2022, whereby the learned Single Judge has rejected the claim of the appellant/writ petitioner on the ground of delay and laches in approaching the Court.
2.
Learned counsel for appellant submits that the reservation for Special Backward Classes and Most Backward Classes had been introduced by the State Government on 23.06.2019, and the same was not considered at the time of appointment.
3. We have considered the contentions.
[2026:RJ-JP:5485-DB] (2 of 2) [SAW-1259/2022]
4. Apart from the petition having been dismissed on the ground of laches, we have examined the case even on merits. We find that the advertisement was issued on 30.12.2015, the examination was conducted on 14.09.2018 and the appointment orders had been issued on 31.05.2019. Till the date of issuance of appointment orders, there was no notification issued for reservation of Most Backward Classes by the State Government and the decision for same was taken on 23.06.2019. Thus, no case even on merits is made out and the claim is wholly misconceived.
5. Accordingly, the present special appeal writ is dismissed.
6. All pending application(s), if any, stand disposed of.
