In this petition, the petitioner is assailing the order dated 16.01.1982 in K.L.R.M.A.77-74 passed by the Land Tribunal, Mysore rejecting the application made by the father of the petitioner (Annexure-F). 3. It is the case of the petitioner that, the father of the petitioner made an application seeking occupancy right which came to be rejected by the competent authority as per Annexure-F to the writ petition and accordingly, sought for interference of this Court. 4. Per contra, learned AGA Sri. B.J. Eswarappa, appearing for the respondents submits that since the order impugned is passed in the year 1982, the petition deserves to be dismissed on the ground of delay and latches. - 3 - HC-KAR NC: 2026:KHC:26059 WP No. 15292 of 2026 5. In the light of the submission made by the learned counsels appearing for the parties and on careful consideration of the impugned order at Annexure-F, which is undoubtedly passed on 16.01.1982 by the Land Tribunal, Mysore and also on careful consideration of the averments made in the writ petition wherein, no acceptable reasons have been made to condone the delay of more than 4 decades. In that view of the matter, following the declaration of law made by the Hon'ble Supreme Court in the case of Shivamma (Dead) By Lrs V.S Karnataka Housing Board And Others1 and in the case of H. Guruswamy And Others V.S A. Krishnaiah Since Deceased by LRS2. I am of the view that, no interference is called for in this petition.
