1. The present petition has been filed seeking quashing of FIR No.674/2023 under Sections 498A/406/34 of the Indian Penal Code, 1860 (IPC), registered on 19th August 2023 at Police Station Nangloi, Delhi, on the basis of settlement. 2. The petitioner is the husband of the respondent no.2. The marriage of the petitioner and respondent no.2 was solemnised on 15th April, 2025 as per Hindu rites and ceremonies. Matrimonial disputes arose between the petitioner and respondent no.2, which resulted in the filing of the present This is a digitally signed order. Counsel for the petitioner submits that the matter has been settled between the petitioner and the respondent no.2 before the Counselling Cell, Family Court, Tis Hazari on 7th June 2024 (Annexure-2). In terms of the settlement, the balance amount of Rs.2,00,000/- being the last tranche of the total settlement amount of Rs.6,00,000/- has been paid by way of demand draft by the petitioner to the respondent no.2. 4. The demand draft has been handed over to the counsel for respondent no.2. Copy of the divorce decree dated 4th March, 2024 has also been placed on record. 5. Issue Notice. 6. Notice is accepted by the ASC appearing on behalf of the State and the counsel appearing on behalf of the respondent no.2. 7. The respondent no.2 is present in Court and has been identified by her counsel as well as by the Investigating Officer (IO).
She informs the Court that she has settled the matter of her own free will and without any coercion. She further states that she has no objection to quashing of the FIR. 8. The petitioner is also present in Court and has been identified by his counsel. He affirms the statement of respondent no.2 and undertakes to abide by the terms of settlement arrived at between the parties. 9. Considering the above settlement between the parties, there is no use continuing with the proceedings of the present FIR, as it would be an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the aforementioned FIR and the proceedings pursuant thereto. 10.
