$~38 * IN THE HIGH COURT OF DELHI AT NEW DELHI # CNR No. DLHC010025772025 + W.P.(C) 930/2025 & CM APPL. 4553/2025 J.P.SINGH, ADVOCATE .....Petitioner Through: Mr. J.P. Singh, Adv. versus THE GOVT OF NCT OF DELHI AND ORS.....Respondents Through: Ms. Rachita Garg, Adv. for R1 & R9 (through VC)
CORAM:
HON'BLE MR. JUSTICE AMIT MAHAJAN O R D E R %
23.09.2026
1. The petitioner seeks cancellation of the registration of society, namely, Akhil Bhartiya Prajapati (Kumbhkar) Mahasangh Bhartiya Prajapati (Kumbhkar) Mahasangh (Regd.). Further prayers have been sought for restraining the private respondents from functioning as the office bearers of the said society.
2. It is the claim of the petitioner that he belongs to the community for the benefit of which the society was formed. It is alleged that the society is though registered in Delhi but is operating from Mumbai in contravention of the Societies Registration Act, 1860 (hereafter ‘the Act’). Certain other allegations have also been made in regard to the activities of the society which, according to the petitioner, are in contravention of the Act.
3. The petitioner had given a representation to the Registrar of Societies in that regard, which is annexed as Annexure P-4 to the present petition, however, it appears that the same is still pending
consideration and no decision has been taken till date. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 24/09/2026 at 11:24:06
4. Moreover, the present petition has been pending since January, 2025 and despite being represented, no counter affidavit has also been filed by Respondent No. 1.
5. Today, none appears for Respondent No. 1 either.
6. However, considering the limited dispute, I do not consider it appropriate to keep the present petition pending.
7. The petition is disposed of with direction to Respondent No. 1 to treat the present petition as a representation and pass appropriate orders, in accordance with law, within a period of two weeks.
