The petitioners are apprehending their arrest in connection with Pathrol P.S. Case No.26/2026, registered for the offence under Sections 126(2), 115(2), 117(2), 118(1), 109(1), 74, 303(2), 351(2), 352, 3(5) of the BNS, 2023, pending in the Court of the learned Sub-Divisional Judicial Magistrate, Madhupur. 3. Learned counsel appearing for the petitioners at the outset submits that petitioner no.2, namely, Akshay Kumar Sharma has already been arrested and in view of that, he is not pressing this anticipatory bail application so far as petitioner no.2 is concerned. 4. In view of the above, so far as petitioner no.2, namely, Akshay Kumar Sharma is concerned, this anticipatory bail application is dismissed as not pressed. 5. Learned counsel appearing for the petitioners further submits that now this application is survived only for petitioner no.1, namely, Mundrika Devi. He then submits that petitioner no.1 is a widow lady and there are case and ( 2026:JHHC:19902 ) -2- A.B.A. No. 3624 of 2026 counter case. He next submits that although the allegation of assault is there, however, that was not made on the vital part of the body. On these grounds, he submits that anticipatory bail may kindly be granted to petitioner no.1. 6. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of assault on the leg of the informant and in view of that, the prayer for anticipatory bail of petitioner no.1 may kindly be rejected. 7. Although the allegation of assault is there against petitioner no.1 also, however, the said assault was made on the leg of the informant. The petitioner no.1 is said to be a widow lady. There are case and counter case between the parties. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to petitioner no.1. 8. Accordingly, petitioner no.1, namely, Mundrika Devi is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, she shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhupur in connection with Pathrol P.S.
