Order 20/01/2026
1. The instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No. 224/2025 registered at Police Station Sapotra District Karauli Rural
[2026:RJ-JP:2486] (2 of 4) [CRLMB-13470/2025] for the offences under Sections 189(2), 115(2), 103(1) and 333 of BNS.
2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have been falsely implicated in this case. It is contended that prima facie offence under Section 108 of the BNS is not made out against the petitioners. Police in the investigation has concluded that there was a long rivalry between the parties and petitioners were insisted the deceased to pay the amount and soon before her death altercation took place between the parties. It is contended that the said altercation between the parties cannot be defined as instigation caused by the petitioners for commission of suicide. The accused-petitioners are in custody since long and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed. 3. Learned Public Prosecutor and learned counsel for the complainant vehemently opposed the bail applications and contended that petitioners harassed the deceased and soon before commission of suicide she was subjected to beatings which caused her to commit suicide. It is also contended that against petitioners four cases were registered under various offences and they are habitual offenders, therefore, the bail applications of the accused- petitioners deserve to be dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the parties and after going through the conclusion drawn by the Investigating Officer, without commenting anything on the merits
[2026:RJ-JP:2486] (3 of 4) [CRLMB-13470/2025] of the case, I deem it just and proper to enlarge the accused- petitioners on bail. 6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners
