1. We have heard the learned counsels appearing for the parties. 2. The writ petition can be conveniently disposed of for the following reasons: (a) It is the case of the petitioner that the issue involved herein already stands decided by a Division Bench of this Court vide order dated 21st May, 2026, delivered in W.P (C) 8154/2024 titled as ‘Ashish Sharma Vs. Union of India and Ors.’ with connected matters. It is urged that the issue as regards the House Rent Allowance(HRA) has already been looked into by this Court in the said matter. said judgment, with equal force, is applicable to the facts of the present case. (b) We are required to be sensitive to the judgment of the Hon’ble Apex Court in the matter of “State of UP & Ors. Vs. Arvind Kumar Srivastava, (2015) 1 SCC 347”.’ (c) It is a settled position of law that in service jurisprudence, once the benefits are conferred on an employee, there need not to be a separate order of the Court conferring similar benefits on other similarly placed employees. as ipso facto such benefits are required to be extended. 3. In the aforesaid background, we deem it appropriate to dispose of the present petition with a direction to the respondents to consider the case of the petitioner in the light of the Division Bench judgement of this Court in the matter of “Ashish Sharma Vs. Union of India and Ors.”, with connected matters, decided on 21st May, 2026. 4. Let the decision taken thereon be communicated to the petitioner within 12 weeks from today. 5. The petition stands disposed of accordingly. 6. The pending application(s) also stands disposed of accordingly.
