Learned counsel has further submitted that there is no allegation against the petitioner of committing any murder or assault on the deceased. The charge sheet has already been submitted.

Learned counsel appearing on behalf of the opposite party-State has opposed the prayer for bail and has submitted that the petitioner has given incorrect information to the informant of the case that the deceased fell down and that was the cause of death. However, it is not in dispute that so far as the murder of the deceased is concerned, the petitioner is not an accused for that purpose, he happens to be the driver of the vehicle which carried the dead body to the house of the informant.
