HON'BLE MR. JUSTICE GANESH RAM MEENA Order 30/01/2026 1. The petitioner has filed this anticipatory bail application under Section 482 B.N.S.S. arising out of F.I.R. No. 429/2025 registered with the Police Station New Mandi Hindaun, District Karauli for offences punishable under Section 112(2) of B.N.S., 2023 and Section 13 of Rajasthan Public Gambling Ordinance (RPGO) 1949. 2. Heard. 3. Considered the submissions made by the counsel for the accused-petitioner as well as learned Public Prosecutor. 3. Learned counsel for the accused-petitioner submits that [2026:RJ-JP:4383] (2 of 3) [CRLMB-13761/2025] the accused-petitioner has been falsely implicated in this case. He further submits that accused-petitioner has been arrayed as an accused on the basis of the statement of the co-accused named as Rajkumar. He also submits that the version of any accused cannot be read against the other person so as to array him as an accused. He further submits that the accused-petitioner is already cooperating with the investigation. 4. Learned Public Prosecutor opposed the bail application. 5. Taking into consideration the allegations against the accused-petitioner and so also the fact that the accused-petitioner is being implicated as an accused only on the basis of statement of co-accused named as Rajkumar, this Court deems just and proper to extend the benefit of anticipatory bail to the petitioner. 6. The Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station New Mandi Hindaun, District Karauli in F.I.R. No. 429/2025 is directed that in the event of arrest of the accused-petitioner he shall be released on bail, provided of him furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to his satisfaction on the following conditions:- (I). that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii). that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the [2026:RJ-JP:4383] (3 of 3) [CRLMB-13761/2025] facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer, and (iii). that the petitioner shall not leave India without previous permission of the Court.
