JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.7 in Crime No.102/2025 registered by Banashankari Police Station, Bengaluru for offences punishable under Sections 310(2), 311, 61 and 238 of BNS, 2023 r/w Sections 25(1-B)(b) and Section 4 of the Arms Act, 1959 is before this Court in this successive bail petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.102/2025 was registered by Banashankari Police Station initially for offence punishable - 3 - HC-KAR NC: 2026:KHC:26705 CRL.P No. 5337 of 2026 under Sections 310(2), 311, 61 and 238 of BNS, 2023, r/w Section 25(1-B)(b) and Section 4 of the Arms Act, 1959, based on the first information dated 31.03.2025 received from Sri Ramesh.T, S/o Timmayya. 4. During the course of investigation, petitioner was arrested on 05.04.2025 and remanded to judicial custody. After completing the investigation, charge sheet is now filed against eight accused persons. Petitioner was arraigned as accused No.7 in the charge sheet. His bail petition filed before the jurisdictional Sessions court was rejected and therefore he had earlier approached this Court in Crl.P.No.15518/2025 which was dismissed by the co-ordinate bench of this Court on 11.12.2025. Subsequently, some of the accused as against whom similar allegations were found in the charge sheet have been granted regular bail by this Court. It is under these circumstances, the petitioner is before this court under this successive bail application. - 4 - HC-KAR NC: 2026:KHC:26705 CRL.P No. 5337 of 2026 5. Learned counsel for the petitioner submits that all the accused arrested have been granted bail, except the petitioner. The petitioner, who is a youngster was in custody for more than one year and he has no other criminal antecedents. Accordingly, he prays to allow the petition. 6. Learned High Court Government Pleader submits that all the weapons used in the present case have been recovered at the instance of the petitioner and a sum of Rs.20,000/- is also recovered from the petitioner. Accordingly, he prays to dismiss the petition. 7. Allegation against the accused persons in the present case is that in furtherance of their conspiracy, on 31.03.2025 they had armed themselves with weapons and after covering their face with masks, they had entered the premises of BVK Club, at about 10.00 a.m., and after threatening the first informant who was playing cards in the said club along with others they allegedly had taken - 5 - HC-KAR NC: 2026:KHC:26705 CRL.P No. 5337 of 2026 away cash of Rs10.00 lakhs and also 700 grams of gold jewellery. The allegation of entering the club premises and committing the crime is found against accused Nos.2 to 5 and 7. The other accused persons alleged were the conspirators to the crime. Accused No.2 has been granted regular bail in Crl.P.No.3104/2026 disposed of on 23.03.2026. The accused No.6 has been granted regular bail in Crl.P.No.11305/2025 and Crl.P.No.3204/2026. Accused No.4 has been granted regular bail in Crl.P.No.14792/2026. The allegation as against the petitioner and the accused Nos.2 and 4 are similar in the charge sheet. The alleged offences are neither punishable with death nor with life imprisonment. The petitioner, who is a youngster is in the custody for the last one year. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. The petitioner is directed to be enlarged on bail in Crime No.102/2025 registered by Banashankari Police Station, Bengaluru for the offences punishable under Sections 310(2), 311, 61 and 238 of BNS, 2023 r/w Sections 25(1-B)(b) and Section 4 of the Arms Act, 1959, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 7 - HC-KAR NC: 2026:KHC:26705 CRL.P No. 5337 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
