JUSTICE S VISHWAJITH SHETTY ORAL ORDER The accused in Crime No.307/2025 registered by Kadugodi Police Station for the offence punishable under Section 108 of the Bharatiya Nyaya Sanhitha (BNS), 2023 is before this Court seeking regular bail filed under Section 483 of BNSS. 2. Heard the learned counsel appearing for the petitioner and learned Additional State Public Prosecutor on behalf of the respondent - State. 3. FIR in the present case was registered against the petitioner based on the first information dated 21.06.2025 submitted by the father of the deceased - Diya. During the course of investigation, the petitioner herein was arrested on 13.08.2025 and remanded to judicial custody. Investigation of the case is completed and charge sheet is - 3 - HC-KAR NC: 2026:KHC:26325 CRL.P No. 2654 of 2026 filed. The petitioner herein is arraigned as accused No.1 in the charge sheet for the aforesaid offence. 4. The bail application filed by the petitioner before the jurisdictional Sessions Court in Crl.Misc.No.2502/2025 was dismissed on 26.09.2025. Therefore, he is before this Court. 5. Perusal of the materials on record goes to show that the daughter of the first Informant was aged about 20 years and she had committed suicide by hanging herself in her house on 10.06.2025. Thereafter, UDR case was registered and body of the deceased was cremated. Subsequently, on 20.06.2025, when the first Informant was checking the mobile phone of Diya, he came to know that she was in love with the petitioner. It is under these circumstances, Diya's father had submitted first information. It is relevant to note here that the first information was submitted in the present case after lapse of 11 days from the date on which Diya had committed - 4 - HC-KAR NC: 2026:KHC:26325 CRL.P No. 2654 of 2026 suicide. The petitioner is aged about 22 years. He is in custody from 13.08.2025. Investigation of the case is completed and charge sheet has been filed. Either in the first information or in the charge sheet, there is no mention about any such act committed by the petitioner immediately prior to Diya committing suicide, which could have instigated and abetted her to commit suicide. Undisputedly, the petitioner has no criminal antecedents. Under these circumstances, I am of the opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. 6. Accordingly, the following: ORDER The petitioner is directed to be enlarged on bail in C.C.No.16135/2025 pending before the Court of Additional Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru arising out of Crime No.307/2025 registered by Kadugodi Police Station for the offence punishable under - 5 - HC-KAR NC: 2026:KHC:26325 CRL.P No. 2654 of 2026 Section 108 of the Bharatiya Nyaya Sanhitha (BNS), 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NBM List No.: 1 Sl No.: 29
