1. This writ petition is filed by the petitioner seeking the following reliefs:
“a) grant a writ of Mandamus or such other appropriate writ,
order or direction to Respondent directing the Respondent to permit the Petitioner to operate the Central Canteen in the premises of the Respondent till July 2024; b) grant a writ of Mandamus or such other appropriate writ, order or direction to the Respondent directing the Respondent to settle all the outstanding invoices of the Petitioner adjusting the amount against the outstanding License fee amount and pay the remaining amount of the Petitioner; costs of this petition;”

It remains undisputed, as was noted in the order dated 25.04.2023, that the petitioner has already handed over the canteen premises to the respondent, therefore, the only dispute remaining, in the present petition, is with regard to the alleged outstanding invoices of the petitioner. 3. lieu of pending invoices, after adjusting the amount of license fee and other charges. 4. Counter affidavit has been filed by the respondent wherein it is averred that the outstanding bills, due to the petitioner, amounting to ₹45,76,283/- are outstanding as per their accounts. They also stated that outstanding dues of license fee, water charges and other charges are to the extent of ₹94,93,870/-. Therefore, it is the case of the respondents that petitioner has to pay an amount of ₹25,35,705/-. 5. The dispute arises out of the contractual arrangement between the parties and as noted above, serious disputes and question of facts are involved in the present petition. The same cannot be gone into by this Court while exercising extraordinary jurisdiction under Article 226 of the Constitution of India and the same would certainly require appreciation of evidence and a proper trial by the competent forum. 6. In view of the above, the writ petition is disposed of with liberty to the petitioner to take steps for recovery of the alleged outstanding dues in accordance with law. 7. However, considering that the present petition has been pending since the year 2023, benefit of Section 14 of the Limitation Act, 1963 shall be available to the petitioner. 8.
All rights and contentions in regard to the payment of outstanding invoices or the amount that may be payable in regard to license fee or other charges are left open. 9.
