Virender Singh, Judge (Oral) After   arguing   for   some   time,   learned   vice counsel for the appellant, under instructions, has sought permission to withdraw the present appeal, as well as, the petition under Section 163­A of Motor Vehicles Act, with liberty to approach the learned MACT, under the provisions of Section 166 of Motor Vehicles Act. 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 2026:HHC:34786 2. In addition to this, learned vice counsel for the appellant   has   also   sought   the   permission   to   grant   the benefit of Section 14 of Limitation Act. 3. The   present   appeal   has   been   sought   to   the withdrawn,   on   the   ground,   of   technical   defect   in   the petition. 4. Considering   the   provisions   of   Motor   Vehicles Act, which is beneficial in nature, the requisite permission as sought by the appellant, is granted.   The appellant is permitted   to   withdraw   the   present   appeal,   as   well   as, petition under Section 163­A of Motor Vehicles Act and liberty is accorded to the appellant to approach the learned MACT,   under   the   provisions   of   Section   166   of   Motor Vehicles Act. 5. In case, the petition is filed within a period of four weeks, from today, then the appellant will be entitled to the benefit of Section 14 of Limitation Act. 6. The Insurance Company is at liberty to take all the   defence(s),   including   the   maintainability,   before   the learned MACT, in case, petition under Section 166 of Motor Vehicles Act is filed. 7.
