ORAL ORDER
1. The Petitioners are before this Court seeking for the following reliefs; A. Quash the proceedings initiated against the petitioners in L.G.C (G)No.172/2024 in LGC Court Hall-1, Bengaluru for the offences punishable under Section 4(3) of the Karnataka Land Grabbing Prohibition Act, 2011. B. Pass any other order or direction as this Hon’ble Court deems fit in the circumstances of the case to meet the ends of justice

2. Once earlier, the vendor of the petitioners had approached this Court by filing Cr.P.No.4140/2020, challenging the first information report in Crime No.97/2020 registered on 07.08.2020 by the Sampigehalli Police. 3.
This Court, vide order dated 22.10.2020, being of the opinion that there being a special statute which has come into force, namely the Karnataka Land Grabbing Prohibition Act, 2011, under which separate Courts have been established. It would be for the respondent therein to initiate proceedings thereunder and as such, quashed the criminal proceedings. Pursuant thereto, the respondent has initiated proceedings before the Land Grabbing Court in L.G.C.(G).No.172/2024. It is challenging the said initiation of proceedings that the petitioner is before this Court. 4. The submission of learned counsel for the petitioners is that the property in question is a private property belonging to the family of the vendors of the petitioners and the petitioners have subsequently purchased the said property. The same being private property, the

respondent cannot initiate proceedings under Land Grabbing Act on the ground that the property is Government property. In regard thereto, several documents have been produced by the petitioners. 5. The present proceedings being for quashing under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. The disputed question of fact cannot be gone into in these proceedings inasmuch as there is nothing categorically indicating that the land is private land as contended by the petitioners. Though there are several documents which have been placed on record, the identity of the property has to be ascertained after leading of evidence in those proceedings. The defences, if any, which are available to the petitioners, could always be agitated in those pending proceedings. 6. Reserving liberty to do so, the petition stands disposed.
