The petitioner has filed this petition with a prayer to decide the Second Appeal No. A/3698/2025 pending before the Chhattisgarh State Information Commission. Learned counsel for the petitioner submits that the present petition has been filed seeking a direction to respondent No. 2 to decide the petitioner’s second appeal within a time-bound manner. It is submitted that the petitioner initially filed an application seeking information from respondent No. 4 on 10.07.2025, however, the said application remained pending and no information was furnished within the period stipulated under the provisions of the Right to Information Act, 2005 (hereinafter called as “RTI Act’) and the Rules framed thereunder. Thereafter, the petitioner preferred first appeal before the designated appellate authority on 19.08.2025, but the same has also remained pending till date without any adjudication. Learned counsel further submits that, being aggrieved by the inaction of the authorities, the petitioner was constrained to file a second appeal before the Commission on 25.09.2025, which was received by the Commission on 30.09.2025. However, despite lapse of considerable time, the said second appeal has neither been listed for hearing nor decided and is still pending before the Commission. 3. Considering the fact that the second appeal preferred by the petitioner on 25.09.2025, which was received by the Chhattisgarh State Information Commission, has remained pending for more than seven months and has neither been listed for hearing nor decided till date, this Court is of the considered opinion that the matter deserves to be disposed of with a direction to the respondent No. 1 to expeditiously decide the same. 4. Accordingly, respondent No. 1/Chhattisgarh State Information Commission is directed to consider and decide Second Appeal No. A/3698/2025on 25.09.2025, in accordance with law, as early as possible, preferably within a period of two months from the date of receipt of a copy of this order. 3 5.
