Order on Board 11.05.2026
1. This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 02/2026 registered at Police Station : Puspal, District Sukma, (C.G.) for the offence punishable under Section 64(2)(m) of the Bharatiya Nyaya Sanhita, 2023.
2. The prosecution story in brief is that the complainant lodged a report at the concerned Police Station alleging that the victim was having a RAHUL DEWANGAN Digitally signed by RAHUL DEWANGAN
2 love affair with the present applicant and during the course of their relationship, the applicant allegedly established physical relations with the victim on several occasions on the pretext of marriage. On the basis of the said complaint, the police registered an FIR against the present applicant for the offence punishable under Section 64(2) (m) of the Bharatiya Nyaya Sanhita (BNS). During the course of investigation, the applicant was implicated in the alleged offence and apprehending his arrest in connection with the said crime. Hence, the present bail application has been filed.
3.
Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the present case and has not committed any offence as alleged against him. It is further submitted that the victim was in a consensual love relationship with the applicant and during the entire course of their relationship, she never raised any objection regarding the alleged physical relations. He submits that the victim is a major girl and was fully aware of the consequences of her acts and the relationship between the parties was consensual in nature. It is further submitted that the allegations levelled against the applicant are false, baseless and based upon a concocted and fabricated story. He also submits that the police have implicated the applicant without conducting proper inquiry into the matter and, looking to the material available on record, no prima facie case is made out against the present applicant. The Applicant has no criminal antecedents, the charge-sheet has already been filed, he is in jail since 19.02.2026, his continued incarceration would serve no useful purpose, and the conclusion of the trial may
3 take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand learned State counsel opposes the bail application of the present applicant and submits that the charge- sheet has been submitted before the competent Court in the present case. She further submits that the victim has specifically alleged in her statement that the present applicant established physical relations with her repeatedly on the false promise of marriage. It is further submitted that the allegations levelled against the applicant are serious in nature and are duly supported by the statement of the prosecutrix recorded during investigation. Considering the nature and gravity of the offence as well as the material available on record against the applicant, he is not entitled for grant of regular bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the nature of allegations levelled against the present applicant, the fact that the victim is a major girl and the material available on record prima facie reflects that both parties were in a consensual relationship, the absence of any allegation of forceful physical relations during the subsistence of their relationship.
Further considering the fact that the charge-sheet has already been submitted in the present case before the competent Court, he has no previous criminal antecedents, and the present applicant is in jail since 19.02.2026
4 and the trial is likely to take sometime for its conclusion, therefore, I am of the opinion that the applicant is entitled to be released on bail in this case. 7. Accordingly, the bail application of the applicant is allowed.
