The applicant has preferred this First Bail Application under Section 483 of The Bharatiya Nagarik Suraksha Sanhita (BNSS) for grant of regular bail, as he has been arrested in connection ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.05.15 19:07:57 +0530 2 with Crime No.334/2025, registered at Police Station Ganj, District Raipur (C.G.) for the offence punishable under Section 22(B) of the NDPS Act. 3. Learned counsel for the applicant submits that in compliance to Court’s order dated 27.04.2026, the Deponent-Naresh Rajendra Prasad Pandey i.e., father of the applicant (Harsh Naresh Pandey) has filed an affidavit tendering unconditional apology. Relevant paras of the affidavit are reproduced hereinbelow: “2. At the very outset, with folded hands and utmost reverence to the majesty of this Hon'ble Court, I tender my absolute, Unconditional, and unqualified apology for the filing of the Affidavit in support of the bail application before the learned Special Judge (NDPS Act), Raipur, during the pendency of the present bail application before this Hon'ble Court. I have the highest respect for this Hon'ble Court and the judicial process, and I never had any intention to commit forgery, perjury, contempt of Court, or to undermine the dignity of the legal system. 3. I humbly submit that the error occurred entirely out of my ignorance of the law and lack of understanding of the technical and legal consequences of the documents I was signing, and not out of any deliberate or malafide intent to suppress material facts or mislead the judicial process.” 4. At this stage, learned counsel for the applicants seeks permission to withdraw the present bail application. 5. The apology rendered by the Deponent-Naresh Rajendra Prasad Pandey i.e., father of the applicant (Harsh Naresh Pandey), is 3 hereby accepted with a word of strict caution and ensure that he shall not repeat such instance in future. 6. Accordingly, the present bail application stands dismissed as withdrawn. 7.
