This suit is instituted by the Plaintiffs inter alia seeking a decree of permanent injunction against the Defendant and all others acting on its behalf from using the impugned mark BetVertin/ and/or any other mark/device/logo or trade name, which is identical and/or deceptively similar to Plaintiffs’ registered trademark VERTIN, in any manner whatsoever, without the permission, consent or license of the Plaintiffs, amounting to infringement and/or passing off. 2. By order dated 23.12.2025, this suit was decreed in terms of paragraph 97(a), (b), (c), (d) and (g) of the plaint in favour of the Plaintiffs and against the Defendant on a statement made on behalf of the Defendant This is a digitally signed order. On 13.03.2026, parties were referred for mediation to amicably resolve their disputes, on I.A. 6428/2026 being filed by the Defendant for reference. Parties have settled the disputes and Settlement Agreement dated 24.07.2026 has been executed, incorporating the terms of settlement. Defendant has inter alia agreed to pay a sum of Rs. 9,00,000/- to the Plaintiffs in full and final settlement of all their claims and the amount stands paid, which is acknowledged by counsel for the Plaintiffs. The terms of settlement are lawful and accordingly, the suit is decreed in favour of the Plaintiffs and against the Defendant in terms of the settlement read with paragraph 97(f) of the plaint, since Plaintiffs have given up the remaining reliefs. 4.
