02/07.07.2026 I.A. No. 8975 of 2026:
1. The present interlocutory application seeks leave to withdraw the present L.P.A. with liberty to seek review of the impugned order dated 04.07.2025 passed in W.P.(S) No. 4294 of 2019. 2. We grant leave with the liberty as prayed for. 3. However, we clarify that the grant of such liberty can neither be utilized for not complying with the impugned order dated 04.07.2025 nor should it be automatically taken as a ground for seeking condonation of delay. 4. The above is because we are not quite sure about the bonafides of filing such an application. There are several instances where the State simply files an L.P.A. beyond the prescribed period of limitation, keeps it pending and cites it as a reason for not

complying with the learned Single Judge’s impugned order. We are not too sure whether the filing of this interlocutory application and seeking liberty is yet another attempt in the same direction. 5. Accordingly, I.A. No. 8975 of 2026 is allowed. L.P.A. No. 228 of 2026:
6. In view of the order passed in I.A. No. 8975 of 2026, the present L.P.A. is disposed of as withdrawn with the aforesaid liberty. 7. However, all contentions of the parties on the issues of limitation, maintainability of the review petition etc. are specifically kept open. 8.
Once again, we clarify that all this should not be used as an excuse for not complying with the impugned order dated 04.07.2025 because till date, the State has not obtained any interim relief, based upon which, the implementation of the impugned order can be avoided. 9. Other pending interlocutory applications are disposed of with liberty and clarification in the above terms. (M. S. SONAK, C.J.)
