Declaring Rule 3 of the Andhra Pradesh Police (Special Police Battalions) Subordinate Service Rules, notified vide G.O.Ms.No.69, Home (Police-D) Department, dated07-04-1997, and Rule 1(b) of G.O.Ms.No.85, Home (Police-D) Department, dated 28- 04-1997, insofar as they provide for Commandant of each Battalion as the appointing authority, battalion-wise seniority, and battalion- wise promotions up to the rank of Assistant Reserve Sub-Inspector in respect of posts of Police Constable, Head Constable and Assistant Reserve Sub-Inspector in the Andhra Pradesh Special Police Battalions, as being contrary to and unenforceable in view of the Andhra Pradesh Public Employment (Organisation of Local Cadres and Regulation of Direct Recruitment) Order, 1975 dated 20-10-1975 issued under Article 371-D of the Constitution of India
2. Declaring that the posts of Police Constable (PC), Head Constable (HC) and Assistant Reserve Sub-Inspector (ARSI) in the Andhra Pradesh Special Police Battalions are State cadre posts, to which State-wide seniority must apply 3. Directing the Respondents to prepare and follow a common State-wide seniority list for the aforesaid categories in accordance with the Presidential Order 4. Directing the Respondents to place the Petitioner above all his juniors who were promoted earlier under the illegal battalion-wise regime, and to grant all consequential notional and service benefits in accordance with law 5.
