ARB.P. 1706/2026 2
Arbitrator is one of the members of Works Committee of Indira Gandhi National Open University (IGNOU) and since the case pertained to a matter where IGNOU was also one of the parties, he recused claiming conflict of interest.
6. Reference be made to his letter dated 21.08.2024.
7.
Learned counsel for petitioner submits that, thereafter, they had received one communication from Delhi International Arbitration Centre (DIAC), asking the parties to give a name with mutual consensus or else, to file appropriate petition seeking substitution. He submits that, in the interregnum, the parties were also trying to resolve the matter amicably and, therefore, there is a delay in filing the present petition.
8.
Learned counsel for respondent appears on advance notice and submits that he would have no objection if a new Sole Arbitrator having engineering background is appointed by DIAC from its empanelled list.
9. Present petition is accordingly disposed of with request to DIAC to appoint Sole Arbitrator having engineering background from its empanelled list, as per Rules.
