ORAL ORDER
1. Accused in S.C.No.5071/2025 pending before the III Additional District & Sessions Judge, Bengaluru Rural District sitting at Anekal, arising out of Crime No.82/2025 registered by Suryanagar Police Station, Bangalore, for the offence punishable under Section 103 of BNS, 2023, is before this Court in this petition under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard learned counsel for the petitioner and the learned HCGP for the respondent-State. 3. FIR in the present case was registered in Crime No.82/2025 by the Suryanagar Police Station, Bengaluru, for the aforesaid offence against the petitioner herein based on the first information dated 24.02.2025 received from Sri. Srikanth. During the course of investigation, petitioner herein was

arrested on 27.02.2025 and remanded to judicial custody. After completion of investigation, a detailed charge sheet was filed against him for the aforesaid offence. His bail application before the Sessions Court in S.C.No.5071/2025 was rejected on
11.09.2025. Therefore, he is before this Court. 4. The first informant in the present case is a hearsay witness. Based on the information received, he had approached the police and submitted the first information, which has resulted in registering FIR in Crime No.82/2025 against the petitioner. After completing the investigation, charge sheet has now been filed against the petitioner. As per the charge sheet allegation, deceased Muthukumar had insisted the petitioner to provide him liquor and therefore, they had fought against each other. Subsequently, the petitioner had taken the deceased along with him on the premise of providing liquor and allegedly assaulted him with a wooden club and committed his murder. The entire case of the prosecution is based on circumstantial evidence. The petitioner otherwise had no motive or ill-will as against the deceased. Except the last seen theory, there is no otherstrong circumstances as against the petitioner at this

stage. Petitioner is in custody in the present case from 27.02.2025 onwards. Trial in the case is yet to commence. Under these circumstances, I am of the view that his prayer for grant of regular bail is to be answered in the affirmative. 5. The petition is allowed.
The petitioner is directed to be enlarged on bail in S.C.No.5071/2025 arising out of Crime No.82/2025 of Suryanagar Police Station pending on the file of III Addl. District & Sessions Judge, Bengaluru Rural District sitting at Anekal, registered for the offence punishable under Section 103 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, out of which one surety shall be local surety, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
