Order 20/01/2026

consideration of his case in the light of law laid down by the Hon’ble Supreme Court in the case of Avtar Singh v. Union of India & Ors. reported in (2016) INSC 543.
2. For ready reference, we deem it apposite to reproduce the short order dated 19.05.2025:-
“Learned counsel for the petitioner after arguing at length is not pressing this petition with liberty to approach the department for
consideration of the case of the petitioner in accordance with law laid down by the Supreme Court in Avtar Singh Vs. Union of India & Ors. reported in (2016) INSC 543. The petition is disposed of as not pressed with liberty as prayed for.”
3. In the reply to the contempt petition, the respondents have placed on record an order dated 22.09.2025 passed on the representation submitted by the petitioner in furtherance to the liberty granted to the petitioner vide order dated 19.05.2025.
4. The order has been passed on merits and the grievance of
learned counsel for the petitioner is that the order is not sustainable in the eye of law.
5. Be that as it may, learned counsel for the petitioner does not dispute that passing of the order dated 22.09.2025 on merits, gave rise a fresh cause of action, to assail the same on merits and in such eventuality, the respondents may not be held guilty for flouting the order dated 19.05.2025 more so deliberate and willful.
6.
Learned counsel for the petitioner prays for granting liberty to assail the order dated 22.09.2025 in accordance with law.
7. In view of the above, the proceedings of present contempt petition are hereby closed.
8. Notice(s) of contempt stands discharged.
[2026:RJ-JP:2338-DB] (3 of 3) [CCP-1180/2025]
