In this writ petition, the prayer of the petitioner is to implement the agreement and MOU, which has been entered between one Essar Power Jharkhand Ltd. Company, Chandwa and the villagers. 3. The Essar Power Jharkhand Ltd. Company, against whom, the relief has been sought for does not come within Article 12 of the Constitution of India. Further, the petitioner’s prayer to enforce the agreement, cannot be entertained in an application under Article 226 of the Constitution of India. Further, this agreement is a private agreement which has no statutory backing. 4. The petitioner, if he wants to enforce the agreement or the agreement or any clause of the agreement, has to approach the Civil Court praying for specific performance of the contract. 5. Thus, I am not inclined to entertain this writ petition. Liberty is reserved with the petitioner to approach the Civil Court for appropriate relief. 6.
