JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court seeking the following prayers: "i. Set aside the order dated 08.04.2026 passed by the Hon'ble Court of the XXXIV Additional Chief Judicial Magistrate, Bengaluru City, Mayo Hall, issuing a conviction warrant against Petitioner No.2 and remanding him to judicial custody, i.e., Annexure-A ii. Consequently, direct the release of Petitioner No.2 from judicial custody forthwith." 2. Heard Sri.Siddarth Suman, learned counsel appearing for the petitioners and have perused the material on record. 3. The petitioner No.2 suffers an order of conviction for the offence punishable under section 138 of the Negotiable Instruments Act, is said to have preferred an appeal and an application seeking suspension of sentence. 4. Learned counsel appearing for the petitioner submits that the concerned Appellate Court has not considered the application for a long time close to five months and now the - 4 - HC-KAR NC: 2026:KHC:20195 CRL.P No. 5764 of 2026 petitioner No.2 is said to be taken into custody. He is now suffering from illness and would submit that the court of the Magistrate has convicted the petitioner. An application is filed seeking stay of the said sentence till the Appellate Court would consider the same. Application is pending consideration. 5. The Court shall now answer the application and the petitioner No.2 is left with remedy open once there is an answer to the application. Therefore, wherever application is pending, the concerned Court shall take it up. In that light, the petition stands disposed reserving such liberty.
