such period; and C. pass such order and further orders as may be deemed fit and proper in the facts and circumstances of this petition in favor of the petitioner and against the respondent.”
4.
Learned counsel for petitioner during the course of his arguments submits that the petitioner apprehends that a sealing order may be passed by the respondent/ MCD and the same may be given effect immediately.
5. At the very outset, learned counsel for respondent/ MCD submits that since only a Show Cause Notice has been issued to the petitioner, the concern of the petitioner is only based on an apprehension and thus, the present petition, being premature, is not maintainable. In any event, he also submits that the petitioner will be granted a personal hearing in accordance with law, if, as and when required.
6. Based on the factual matrix involved, however, without adverting to the merits therein, since the Show Cause Notice is still pending as of date, no coercive steps shall be taken by the respondent/ MCD against the petitioner’s property bearing no. A-491, New Ashok Nagar, Delhi-96 till the adjudication/ outcome thereof.
7. Accordingly, the present petition is disposed of.
