In the present writ petition, the petitioner has assailed the Endorsement dated 29.09.2014 (Annexure–D), inter-alia, sought a direction to the respondents to permit the petitioner to utilise the karab land situated in Sy.No.102 of Madhapura Village, Honnahalli Taluk, Davanagere District. 3. Having considered the submissions made by the learned counsel appearing for the parties and upon perusal of the impugned Endorsement at Annexure–D, it is evident that the petitioner claims rights in respect of land bearing Sy. No.102 measuring 1 acre 23 guntas. Out of the total extent of land, an area measuring 1 acre, 10 guntas, (karab land) is sought to be utilised for agricultural purposes. - 4 - HC-KAR NC: 2026:KHC:25793 WP No. 53368 of 2014 4. It is a well-established principle of law that karab land attached to an adjoining agricultural land is ordinarily intended to be utilised for additional purposes such as ingress and egress by the parties and not for independent agricultural cultivation. In that view of the matter, the impugned Endorsement issued by the respondents cannot be said to be arbitrary or illegal calling for interference by this Court in exercise of writ jurisdiction. 5. Accordingly, I am of the considered opinion that the Endorsement dated 29.09.2014 at Annexure– D is just and proper and does not call for interference. However, it is made clear that the petitioner is at liberty to utilise the karab land in question for the purpose for which it is earmarked, namely, as a passage for ingress and egress to his agricultural land, - 5 - HC-KAR NC: 2026:KHC:25793 WP No. 53368 of 2014 subject to applicable laws and rules.
