Mr. Rajan Kahol, learned Additional Advocate General while accepting notice on behalf of the respondent- State states that he does not intend to file reply to the application and has no objection in case prayer made in the application is allowed. It appears that Registry while calculating the delay, has failed to subtract the period of 90 days otherwise available for filing Revision, as a result thereof, Criminal Revision Petition has been shown to be barred by 145 days. For the reasons stated in the application, this Court is convinced and satisfied that delay in maintaining the accompanying petition is neither intentional nor willful, rather same has occurred on account of circumstances, which were completely beyond the control of the applicant, as such, delay of 55 days, which has been sufficiently explained, is condoned.
