JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused No.1 in SC No.1567/2025 pending before the Court of LVIII Addl. City Civil and Sessions Judge, Bengaluru, arising out of Crime No.169/2025 registered by Rajarajeshwari Nagar Police Station, Bengaluru, for the offences punishable under Sections 109, 132, 121(1) read with Section 3(5) of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.169/2025 was registered by Rajarajeshwari Nagar Police Station, Bengaluru, against petitioner herein and another based on the first information dated 15.06.2025 received from Kempegowda, police officer attached to Rajarajeshwari Nagar Police Station. Petitioner, who was arrested in the said case on 21.07.2025 was remanded to judicial custody and after completing investigation, charge sheet is filed for the aforesaid offences and petitioner is arraigned as accused No.1 in the charge sheet. His bail application filed before the Trial Court in - 3 - HC-KAR NC: 2026:KHC:26833 CRL.P No. 5214 of 2026 Crl.Misc.No.11112/2025 was dismissed on 25.02.2026. Therefore, he is before this Court. 4. A perusal of the material on record would go to show that petitioner allegedly was involved in Crime No.99/2025 registered by JJ Nagar Police Station, Bengaluru for the offence punishable under Section 103 of BNS, 2023. After receiving credible information about the whereabouts of the petitioner, police attached to Rajarajeshwarinagar Police Station, Bengaluru, had made an attempt to apprehend him. Petitioner, who was present along with accused No.2 in the present case had allegedly tried to attack the police staff with a knife which he was holding and as a result, one of the police staff had sustained simple injuries in the incident in question. In spite of warning, accused persons refused to surrender and tried to attack the police staff and it is under these circumstances, CW- 4 had shot from the service pistol on the left leg of petitioner and thereafter, arrested him. In the incident in question, victim has suffered only simple injuries whereas the petitioner has suffered grievous injuries and he was admitted in the Hospital for a considerable period of time. He is now in custody in the - 4 - HC-KAR NC: 2026:KHC:26833 CRL.P No. 5214 of 2026 present case from 21.07.2025. After completing investigation, charge sheet has been already filed against the petitioner in the present case. Under the circumstances, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively. Accordingly, the following:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.1567/2025 pending before the Court of LVIII Addl. City Civil and Sessions Judge, Bengaluru, arising out of Crime No.169/2025 registered by Rajarajeshwari Nagar Police Station, Bengaluru, for the offences punishable under Sections 109, 132, 121(1) read with Section 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - HC-KAR NC: 2026:KHC:26833 CRL.P No. 5214 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
