Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 18.05.2026 02. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Jaleswar P.S. Case No.142 of 2026 corresponding to C.T. Case No.173 of 2026 pending in the file of learned J.M.F.C., Jaleswar on the grounds stated. 3. Perused the FIRs as at Annexures-1 and 2. Mr. Jena, learned counsel for the petitioners submits that for the same incident, there is a counter FIR i.e. Annexure-2. It is submitted that the parties are related to each other and belong to one family and for reasons stated in the FIR, the alleged incident took place but none received any serious injury. This Court by order dated 27th April, 2026 directed the State to submit the medical examination reports since the assault was allegedly by means of a ‘Thenga’. Though the case diary submitted with medical prescriptions but no injury reports are made available. The medical prescriptions reveal that the victim received swelling and other injuries and treated at DHH, Balasore and discharged thereafter. The Court finds that the prescriptions do not reveal anything to show that the injuries to be grievous. Since there was damage to the crops by the cattle for which the dispute arose between the parties and then the alleged mischief was committed leading to the lodging of the counter FIRs and as such there is no serious injuries revealed from the medical prescriptions, this Court, though not in favour of entertaining their bail plea but is inclined to direct them to surrender before the learned court below for being released with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned J.M.F.C., Jaleswar in connection with C.T. Case No.173 of 2026 corresponding to Jaleswar P.S. Case No.142 of 2026 within a fortnight from today, they shall be released on bail upon furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) each with one solvent surety for the like amount each with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6.
