2. The petitioner is apprehending his arrest in connection with Mirzachouki P.S. Case No.41 of 2020, for the alleged offences registered under Sections 379, 414, 467, 468 and 471 of Indian Penal Code and Rule 54 of Jharkhand Mines Minerals Concession Rules, 2004 pending in the Court of learned S.D.J.M., Sahibganj.

Learned counsel appearing for the petitioner submits that the petitioner happened to be owner of one of the truck and on the fateful day 139 challans were checked and the allegations are made that on the forged challan 139 trucks were carrying stone chips. She further submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.19 of the petition. She then submits that in identical situation co-accused persons have already been granted anticipatory bail in A.B.A. Nos.1970 of 2021, 3485 of 2021,

2146 of 2021, 880 of 2021, 6555 of 2021, 3742 of 2021, 2755 of 2021, 7280 of 2021, 7922 of 2021 and 9699 of 2021. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposed the prayer and submits that illegally on the forged challan stone chips were being carried as alleged and in view of that anticipatory bail may kindly be rejected.

Considering that in identical situation co-accused persons have already been granted anticipatory bail in the aforesaid A.B.As. and the petitioner has got no criminal antecedent as disclosed in paragraph No.19 of the petition and the petitioner is said to be owner, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Sahibganj in connection with Mirzachouki P.S. Case No.41 of 2020, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
