Learned counsel for the petitioner submitted that during the pendency of the present writ petition, in order to arrest the period of limitation, the petitioner has preferred a statutory appeal before the Commissioner of Income Tax (Appeals) which has been decided and against such order it has preferred an appeal before the Income Tax Appellate Tribunal, which too has been heard by the Tribunal and the order has been reserved.
2. Such being the position, we are not inclined to entertain the present writ This is a digitally signed order.
