The present petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 by the Petitioner seeking appointment of an Arbitrator to adjudicate upon the disputes between the parties under a Purchase Agreement dated 17.02.2025. 2. It is stated that the Respondent issued a Purchase Order for purchase of 20,000 units of Air Conditioners for a sum of Rs.45,68,70,400/-. It is further stated that the said Purchase Order was revised on 05.05.2025 and the quantity of Air Conditioners was reduced to 12,027 units for a sum of Rs. 27,50,00,345/-. 3. It is stated that disputes have arisen between the parties due to failure on the part of the Respondent to procure such units of Air Conditioners as This is a digitally signed order. It is stated that the Clause 23 of the Purchase Agreement dated 17.02.2025 contains an arbitration clause. The said clause specifically states that the place of the arbitration shall be at Delhi. Since the disputes arose between the parties, a notice under Section 21 of the Arbitration and Conciliation Act, 1996 invoking arbitration was sent to the Respondent on 19.08.2025. The said Notice was replied to by the Respondent on 22.09.2025, whereby Respondent denied the claims raised by the Petitioner. 5. Notice in the present Petition was issued on 06.11.2025. This Court notes that on joint request, parties were referred to mediation vide Order dated 27.01.2026. However, on 29.07.2026, this Court recorded that the mediation proceedings between the parties have failed. 6. Accordingly, this Court proceeds with the matter. 7. In view of the fact that disputes have arisen between the parties and the Agreement contains an arbitration clause, this Court is inclined to appoint an Arbitrator to adjudicate upon the disputes between the parties. 8. Accordingly, Ms. Varuna Bhandari Gugnani (Mob. No: 9810400605) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties. 9. The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC. 10. The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the 1996 Act within two weeks of entering on This is a digitally signed order.
