WRIT PETITION NO: 14651/2026 ORDER:
This Writ Petition is filed by the petitioner under Article 226 of the Constitution of India seeking the following relief:-
“to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the Respondent No.3 and 4 in interfering with the Civil disputes between the Petitioners and unofficial Respondents and thereby threatening the Petitioner to enter into their fields to an extent of Ac.0-02 ½ Cents in Sy.No.468 of Marturu Village and Mandal, Bapatla District, is illegal, arbitrary, high-handed and a violation of Article 14 and 21 of the Constitution of india, and consequently direct the Respondent No.3, 4 and their staff not to interfere with the civil disputes in between the Petitioners and unofficial Respondents in respect of property to an extent of Ac. 0-02 ½ Cents in Sy.No.468 of Marturu Village and Mandal, Bapatia District, and to pass
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for the respondents. 3. Learned Assistant Government Pleader for Home submitted the instructions furnished by the 3rd respondent, which reads as under:-
“It is further submitted that on 07.05.2026 on receiving credible information that both parties were present at the disputed site with apprehension of breach of peace, the 4th respondent along with police personnel visited the spot purely in discharging of official duty to maintain public peace and tranquillity. The police did not erect any board, did not attempt to dispossess the Petitioner, and did not hand over possession to the 5th Respondent. The parties were only advised to maintain peace and resolve the dispute through the competent Civil Court. All allegations of high-handedness and collusion are strongly denied as false and concocted. It is further submitted that on 16-05-2026: the Police never called the Petitioenr to Martur Police Station for enquiry.
When the 5th respondent approached the police regarding the above site dispute,
the 4th respondent was clearly explained to the 5th respondent that the police have no power to decide civil disputes relating to title or possession and that the appropriate remedy is to approach the Civil Court or the Revenue Divisional Officer/Tahsildar. Except that, the 4th respondent never threats the petitioner and given to hand over the land or to file a false case. All such allegations are absolutely false, baseless and denied.”

In view of the said instructions, it is submitted that the petitioner was never called to the Police Station, and that on 07.05.2026, upon receiving information that rival parties were present at the disputed site with an apprehension, the Police reached the spot and advised both parties to maintain peace and tranquillity and to resolve the dispute through the competent Civil Court. 5. Recording the said instructions, the Writ Petition is disposed of with a direction to the respondent Police not to interfere in civil disputes without following due process of law. No order as to costs. As a sequel, miscellaneous applications, pending if any, shall stand closed. ________________________
